1. Acceptance of Terms
By accessing or using the Tago platform, including our website, mobile applications, and related services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"), our Privacy Policy, and our Community Guidelines, which are incorporated herein by reference.
If you are using the Services on behalf of an organisation, you represent and warrant that you have authority to bind that organisation to these Terms, and "you" refers to that organisation.
If you do not agree to these Terms in their entirety, you must immediately cease using the Services.
These Terms constitute a legally binding agreement. Please read them carefully.
2. Eligibility
You must be at least 13 years of age (or 16 in the EEA/UK, or the applicable minimum age in your jurisdiction) to use Tago. Users between the applicable minimum age and 18 (or the age of majority in their jurisdiction) may only use the Services with parental or guardian consent.
By creating an account, you represent that: (a) you meet the minimum age requirement; (b) you have the legal capacity to enter into a binding agreement; (c) you are not barred from using the Services under applicable law; and (d) all information you provide is accurate and complete.
Access to certain features (including payments, live streaming monetisation, and certain content) requires you to be 18 or older and may require identity or age verification.
3. Your Account
You are responsible for: (a) maintaining the confidentiality of your account credentials; (b) all activity that occurs under your account; and (c) promptly notifying us at tago@savhfresh.com of any unauthorised access or security breach.
We reserve the right to refuse registration or cancel accounts at our discretion, including for violation of these Terms.
You may not: (i) create multiple accounts to evade restrictions or bans; (ii) transfer your account to another person without our consent; or (iii) use another person's account without their permission.
You may delete your account at any time from Settings. Certain data may be retained after deletion as described in our Privacy Policy.
4. User Content
"User Content" means all content you create, upload, post, transmit, or share on Tago, including videos, audio, images, text, live streams, comments, messages, and product listings.
4.1 Ownership. You retain ownership of your User Content. By posting User Content, you grant Tago and its affiliates a worldwide, non-exclusive, royalty-free, sublicensable, and transferable licence to use, reproduce, distribute, prepare derivative works of, display, and perform your User Content in connection with operating, promoting, and improving the Services. This licence ends when you delete your content, except where it has been shared with others who have not deleted it.
4.2 Responsibility. You are solely responsible for your User Content. You represent and warrant that: (a) you own or have the necessary rights and permissions to post the content; (b) posting the content does not violate any third party's intellectual property rights, privacy rights, or any applicable law; and (c) the content complies with these Terms and our Community Guidelines.
4.3 Content Removal. We may remove or restrict access to User Content that violates these Terms, our Community Guidelines, or applicable law, at our sole discretion and without prior notice. We will provide notice where required by law.
4.4 Feedback. Any feedback, suggestions, or ideas you submit become our property and we may use them without compensation or attribution to you.
5. Prohibited Conduct
You agree not to use the Services to:
(a) Post, transmit, or share content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, sexually explicit, invasive of privacy, hateful, or racially or ethnically objectionable.
(b) Infringe any patent, trademark, trade secret, copyright, or other intellectual property or proprietary rights of any party.
(c) Post content depicting child sexual abuse material (CSAM) — this is a criminal offence and will be reported to the relevant authorities including the National Center for Missing & Exploited Children (NCMEC) and law enforcement worldwide.
(d) Promote, encourage, or facilitate self-harm, suicide, eating disorders, or violence.
(e) Harass, bully, stalk, threaten, or intimidate any individual.
(f) Impersonate any person or entity, or falsely claim an affiliation with any person or entity, including Tago employees.
(g) Spread misinformation that could cause public harm, including false health claims, election misinformation, or dangerous conspiracy theories.
(h) Collect or harvest personal data of other users without their consent.
(i) Transmit spam, unsolicited messages, or chain letters.
(j) Engage in or facilitate fraudulent, deceptive, or manipulative activity, including fake reviews, artificially inflating engagement, or financial fraud.
(k) Sell or facilitate the sale of regulated goods without the required licences, including controlled substances, firearms, counterfeit goods, or items requiring export licences.
(l) Facilitate human trafficking, sexual exploitation, or forced labour.
(m) Violate any applicable law or regulation, including anti-money laundering (AML) and know-your-customer (KYC) requirements.
(n) Circumvent, disable, or interfere with security features, access controls, or technical protection measures.
(o) Reverse engineer, decompile, disassemble, or attempt to extract the source code of the Services.
(p) Use automated means (bots, scrapers, crawlers) to access, collect, or index any portion of the Services without our prior written consent.
(q) Introduce malware, viruses, trojans, or other harmful code.
(r) Conduct or facilitate distributed denial-of-service (DDoS) attacks or any other form of cyber attack.
(s) Use the Services in a manner that competes with Tago without prior written consent.
Violation of any of the above may result in immediate account suspension or termination and may be referred to law enforcement.
6. Commerce and Transactions
6.1 Marketplace. Tago enables creators to sell products and services to buyers through the platform. Tago is not a party to transactions between buyers and sellers except as a payment facilitator.
6.2 Seller Obligations. Sellers must: (a) accurately describe all products and services; (b) fulfil orders within the stated timeframe; (c) comply with all applicable consumer protection, product safety, and distance selling laws (including the EU Consumer Rights Directive, UK Consumer Rights Act 2015, US FTC rules, and equivalent laws); (d) honour returns, refunds, and cancellations as required by law; (e) not sell counterfeit, prohibited, or restricted goods; and (f) hold all required licences and permits for the goods or services sold.
6.3 Buyer Rights. Buyers have all statutory rights under applicable consumer protection law. Nothing in these Terms limits statutory consumer rights.
6.4 Payments. Payments are processed by our third-party payment processor. By making a purchase, you agree to their terms of service. We do not store complete payment card information.
6.5 Fees. Tago charges platform fees on sales as disclosed in our Fee Schedule (available in Creator Studio). Fees are subject to applicable taxes.
6.6 Payouts. Creator payouts are subject to identity verification, tax form collection, and minimum payout thresholds. Payouts may be delayed or withheld if we suspect fraud, disputes, or violations of these Terms. Payouts are subject to applicable tax withholding as required by law.
6.7 Taxes. Sellers are solely responsible for determining and remitting all applicable taxes on their sales, including VAT, GST, sales tax, and income tax. In jurisdictions where we are required by law to collect and remit taxes on your behalf (marketplace facilitator laws), we will do so and disclose this in your transaction records.
6.8 Disputes. Buyer-seller disputes should first be raised with the seller. If unresolved, you may escalate to Tago support. We will use reasonable efforts to mediate but are not obligated to resolve disputes or provide refunds on behalf of sellers.
7. Live Streaming
By going live on Tago, you acknowledge that: (a) your broadcast may be recorded and replayed by the platform; (b) you are solely responsible for all content broadcast; (c) you have obtained all necessary rights, licences, and consents for any music, content, or third parties appearing in your stream; (d) you will not broadcast in a manner that violates applicable laws, including laws regarding public performance, broadcasting rights, wiretapping, or recording without consent; and (e) broadcasting regulated content (including gambling, alcohol, pharmaceuticals, and financial services) may require additional compliance with sector-specific laws.
Virtual gifts sent during live streams are non-refundable once sent and represent a payment for a digital good, not a gratuity or donation. Virtual gift values are set by Tago and are subject to change.
8. Intellectual Property
8.1 Tago IP. All rights, title, and interest in and to the Services (excluding User Content), including software, design, trademarks, logos, and content created by Tago, are owned by Tago or its licensors. Nothing in these Terms grants you any right to use Tago's trademarks without prior written consent.
8.2 DMCA / Copyright Takedown. We respect intellectual property rights. If you believe your copyright has been infringed on Tago, please send a notice compliant with the Digital Millennium Copyright Act (DMCA) or equivalent law to our designated agent at tago@savhfresh.com, including: identification of the copyrighted work; identification of the infringing material and its location; your contact information; a statement of good faith belief; and a statement of accuracy and authority, signed under penalty of perjury.
Repeat infringers will have their accounts terminated in accordance with our repeat infringer policy.
8.3 Trademarks. Tago's name, logo, and related marks are trademarks of Tago. Other trademarks are the property of their respective owners.
9. Privacy
Our collection and use of personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Services, you consent to data practices described in the Privacy Policy.
For users in the EEA and UK, data processing is subject to the GDPR and UK GDPR as described in the Privacy Policy.
10. Third-Party Services
The Services may integrate with or link to third-party services (including Google, Apple, and payment processors). Your use of third-party services is governed by their own terms of service and privacy policies. Tago is not responsible for the content, practices, or policies of third parties.
11. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES.
Nothing in this section affects statutory rights that cannot be excluded under applicable consumer law. In particular, for users in the EEA, UK, and Australia, nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded by law.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TAGO AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THE SERVICES IS LIMITED TO THE GREATER OF: (A) THE AMOUNT YOU PAID TO TAGO IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR (B) USD $100.
THESE LIMITATIONS DO NOT APPLY TO THE EXTENT PROHIBITED BY APPLICABLE LAW, INCLUDING LIABILITY FOR DEATH OR PERSONAL INJURY CAUSED BY NEGLIGENCE OR FOR FRAUD.
13. Indemnification
You agree to indemnify, defend, and hold harmless Tago and its officers, directors, employees, agents, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from: (a) your use of the Services; (b) your User Content; (c) your violation of these Terms; (d) your violation of any third party's rights; or (e) your violation of applicable law.
We reserve the right to assume exclusive control of the defence of any matter subject to indemnification, in which case you agree to cooperate with us.
14. Dispute Resolution
14.1 Informal Resolution. Before initiating formal proceedings, you agree to contact us at tago@savhfresh.com to attempt to resolve the dispute informally. We will try to resolve the dispute within 60 days of receiving your notice.
14.2 Governing Law. These Terms are governed by the laws of [the applicable jurisdiction as disclosed in our jurisdiction-specific terms], without regard to conflict of law principles. For EEA/UK users, the laws of England and Wales govern, and you may bring proceedings in the courts of your country of residence. For Australian users, the laws of New South Wales, Australia govern.
14.3 Arbitration (US Users). For users in the United States, any dispute, claim, or controversy arising out of or relating to these Terms or the Services that cannot be resolved informally shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, except that either party may seek injunctive or other equitable relief in court. YOU WAIVE YOUR RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION. The arbitration will be conducted in English. This arbitration clause does not apply to claims within small claims court jurisdiction.
14.4 Class Action Waiver. To the extent permitted by applicable law, you waive any right to bring or participate in a class action, collective action, or representative action against Tago.
14.5 EU/UK Consumer Rights. Nothing in this section affects mandatory consumer protection rights available to EU or UK consumers, including the right to bring a claim in the courts of the consumer's country of habitual residence.
14.6 Time Limit. Any claim must be brought within one year of the event giving rise to the claim, to the extent permitted by applicable law.
15. Termination
15.1 By You. You may stop using the Services and delete your account at any time from Settings > Account > Delete Account. Deletion is irreversible.
15.2 By Tago. We may suspend or terminate your access to all or part of the Services at any time, with or without notice, for any reason, including: violation of these Terms; illegal activity; fraud; creating risk or legal exposure for Tago; account inactivity; or at our business discretion.
15.3 Effect of Termination. Upon termination: (a) your right to use the Services ceases immediately; (b) we may delete your data as described in our Privacy Policy; (c) provisions that by their nature should survive termination will survive, including Sections 4 (User Content licence), 8 (Intellectual Property), 11-13 (Disclaimers, Liability, Indemnification), and 14 (Dispute Resolution).
15.4 Appeals. You may appeal an account suspension or termination by contacting tago@savhfresh.com within 30 days. We will review and respond within a reasonable time.

We will process valid DMCA notices promptly. Counter-notices may be submitted to the same address. Abusive or false DMCA notices may result in legal liability.
17. Export Controls and Sanctions
You may not use the Services in violation of any export control laws or economic sanctions programmes, including those administered by the U.S. Office of Foreign Assets Control (OFAC), the European Union, the United Nations Security Council, or HM Treasury. You represent and warrant that you are not located in, or a national or resident of, any jurisdiction subject to comprehensive sanctions, and that you are not on any prohibited persons list.
18. General Provisions
18.1 Entire Agreement. These Terms, together with the Privacy Policy and Community Guidelines, constitute the entire agreement between you and Tago regarding the Services and supersede all prior agreements.
18.2 Severability. If any provision of these Terms is found to be unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will remain in full force.
18.3 Waiver. Our failure to enforce any right or provision does not constitute a waiver of that right or provision.
18.4 Assignment. You may not assign or transfer these Terms or any rights under them without our prior written consent. We may assign these Terms at any time, including in connection with a merger or acquisition.
18.5 Notices. We may provide notices to you via email, in-app notifications, or by posting on the Services. Notices to us must be sent to tago@savhfresh.com.
18.6 Force Majeure. We are not liable for delays or failures in performance caused by events beyond our reasonable control, including natural disasters, pandemics, government actions, or telecommunications failures.
18.7 No Third-Party Beneficiaries. These Terms do not create any third-party beneficiary rights.
18.8 Language. These Terms were originally written in English. In the event of any conflict between a translated version and the English version, the English version controls, to the extent permitted by applicable law.
19. Changes to These Terms
We may modify these Terms from time to time. If we make material changes, we will notify you via email and/or a prominent in-app notice at least 30 days before the changes take effect (or as required by applicable law). The "Last Updated" date at the top reflects when changes were last made. Continued use of the Services after the effective date constitutes acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Services before the changes take effect.
